CONDITIONS OF SALE

Prices:
The prices in this catalog cancel all previous lists and quotations. They are based on current market conditions and are subject to change without notice. Quantity rates apply only to orders for the same size and variety. All prices are F.O.B. our Holmdel, NJ location.
Term:
To customers with established credit our terms are net 30 days from the day of the invoice. Overdue accounts are subject to 1.5% per month (18% per annum) service charge plus costs of collection if any. Accounts over 60 days past due will revert to C.O.D. on future orders.
All new accounts must accompany their orders with a deposit of 25%, balance due upon pick-up or delivery. Credit will be extended only to customers who have done a substantial volume of cash business with us for at least a year and can supply three satisfactory references.
Pick-Up and Delivery:
We will gladly supply the labor to load the customer’s truck in our yard. We ask that arrangements be made in advance. It is the customer’s responsibility to provide a cover for the material. We are not responsible for material damaged during transport.
Shipping is the purchaser’s responsibility. If the customer is unable to provide transportation, we can assist in arrangements with a private carrier; the customer agrees to pay the freight charges upon delivery.
Claims:
We guarantee our plants to be true to name and reasonably free of any pests and/or diseases. However, no warranty is expressed or implied as to life, productiveness, or quality of our nursery stock once it leaves our yard. Under no circumstance shall we be liable for an amount greater than the amount originally received for said plants. No claim will be honored unless noted upon the Bill of Lading. Please tell us before your truck leaves the yard if a count discrepancy should arise.
Sales Tax:
Under the New Jersey Sales and Use Tax Act, we are required to collect a 7% tax on all nursery stock sold unless we have proper documentation that the sale is exempt.
